getMRI is not an emergency service. If you are experiencing chest pain, stroke symptoms, severe injury, suicidal thoughts, or any other medical emergency, call 911 immediately or go to the nearest emergency room. Do not use getMRI to seek emergency care.
These Terms of Service (the “Terms”) are a binding agreement between you and getMRI (“getMRI,” “we,” “us,” or “our”) and govern your access to and use of getmri.com and the related online booking and intake services (collectively, the “Services”). By creating an account, submitting a booking request, or otherwise using the Services, you agree to these Terms. If you do not agree, do not use the Services.
1. The service
getMRI is a direct-to-consumer technology platform that lets patients in Florida request medical imaging (such as MRI) online. After you submit intake, a licensed telehealth physician independently reviews your request. If the physician determines that the requested study is clinically appropriate, the physician issues an imaging order and we coordinate scheduling at a partner imaging facility. The actual scan, interpretation, and any follow-up care are performed by independent licensed providers, not by getMRI.
2. Not a medical provider; no physician-patient relationship with getMRI
getMRI is a technology platform. getMRI is not a medical practice, is not a covered entity for most purposes under HIPAA, and is not your treating physician. Using the Services does not create a physician-patient relationship between you and getMRI.
The telehealth physician who reviews your intake and issues your imaging order is an independent contractor, not an employee or agent of getMRI. The imaging center performing your scan is an independent licensed facility. getMRI does not control or direct the clinical judgment of either, and we are not responsible for their clinical decisions.
3. No guarantee of order or scan
Submitting a booking is a request, not a guarantee. The telehealth physician may decline to issue an order if the study is not clinically appropriate, if additional evaluation is needed, or for any other clinical reason. The imaging center may also decline to perform a scan based on safety screening (for example, MRI contraindications such as certain implants) or operational reasons. In those cases, you will not be charged or you will be refunded as described in Section 6.
4. Eligibility
You must be at least 18 years old and able to form a binding contract to use the Services. You must be physically located in Florida at the time the telehealth visit occurs, and you must receive your scan at a participating Florida imaging facility. By using the Services, you represent that all information you provide is accurate, current, and complete, and that you will keep it up to date.
5. Account and intake
You are responsible for the accuracy of your intake answers, including chief complaint, medical history, allergies, medications, prior imaging, and MRI safety screening (implants, devices, pregnancy, etc.). Providing inaccurate or incomplete information can affect the appropriateness of your study and your safety. You agree to keep your account credentials secure and to notify us promptly of any unauthorized access.
6. Fees, payment, and refunds
6.1 Pricing
Scan prices are displayed before you check out. Cash-pay prices are bundled rates that include the telehealth visit, physician order, scan, and standard interpretation. Optional add-ons (such as contrast or copies of images) may incur additional charges.
6.2 Payment methods
We accept (a) cash pay via card, processed by Stripe; (b) Affirm financing, subject to Affirm’s own terms and credit approval; (c) eligible insurance plans where available; and (d) charity care for qualifying patients. Insurance benefits are quoted by your carrier and are not guaranteed by getMRI; you remain responsible for any patient balance after insurance processes the claim.
6.3 Refunds
- Order not issued. If the telehealth physician does not issue an order within 24 hours of your booking, your cash payment is fully refundable on request.
- Scan not performed. If you are turned away at the imaging center for a clinical or safety reason that was not your fault, the scan portion of your payment is fully refundable.
- Patient cancellation. Cancellations made more than 24 hours before your scheduled scan are fully refundable. Cancellations within 24 hours may be subject to a no-show/late-cancellation fee disclosed at booking.
- Completed scans. Once a scan is performed, payment is non-refundable except where required by law.
Refunds are issued to the original payment method. Affirm financing refunds are handled by Affirm under its terms.
7. Telehealth consent
By using the Services, you consent to receive a telehealth evaluation by an independent licensed Florida physician for the limited purpose of determining whether the imaging study you requested is clinically appropriate. You understand that:
- Telehealth is conducted asynchronously and/or by audio/video, not in person.
- The physician’s review is limited to the imaging request and is not a complete medical evaluation. It does not replace your primary care, urgent care, or specialist.
- There are inherent limitations to telehealth, including the inability to perform a hands-on physical examination.
- You can withdraw your consent for the telehealth interaction at any time before the order is issued by emailing support@getmri.com.
8. Communications and SMS
You consent to receive service-related communications by email, SMS, and phone at the contact information you provide, including booking confirmations, intake links, MRI safety questionnaires, appointment reminders, receipts, refund notices, and follow-ups. Standard message and data rates may apply. You can reply STOP to opt out of SMS at any time, but doing so may interrupt service communications about your booking. Marketing communications, if any, are sent separately and you can unsubscribe at any time.
9. Acceptable use
You agree not to:
- Use the Services to book a scan for someone other than yourself, except as a parent or legal guardian for a minor child for whom you have authority to consent and where the Services permit pediatric bookings.
- Submit false, misleading, or fraudulent information.
- Use the Services in a way that violates any law, regulation, or third-party right.
- Interfere with, probe, scan, scrape, reverse engineer, or attempt to disrupt the Services.
- Use any robot, spider, or other automated means to access the Services, except for public-facing pages that explicitly permit indexing.
- Upload viruses, malware, or other harmful code.
We may suspend or terminate access for any conduct that, in our reasonable judgment, violates these Terms or harms the Services or other users.
10. Intellectual property
The Services, including all text, graphics, logos, designs, software, and other content, are owned by getMRI or its licensors and are protected by U.S. and international intellectual-property laws. We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Services for personal, non-commercial use. All rights not expressly granted are reserved. You may not use the “getMRI” name or logos without our prior written permission.
Any feedback or suggestions you provide may be used by us without restriction or compensation.
11. Third-party services
The Services rely on third parties such as Stripe (payments), Affirm (financing), Microsoft 365 (email), Vercel (hosting), and Neon (database). Those parties have their own terms and policies that govern your use of their services. We are not responsible for the acts or omissions of third parties.
12. Disclaimers
THE SERVICES ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS. TO THE FULLEST EXTENT PERMITTED BY LAW, getMRI DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ANY WARRANTIES ARISING FROM COURSE OF DEALING OR USAGE OF TRADE.
getMRI does not warrant that the Services will be uninterrupted, error-free, or secure, or that any imaging order will be issued, or that any scan will diagnose any specific condition. Diagnostic, clinical, and treatment decisions rest with you and your licensed providers.
13. Limitation of liability
TO THE FULLEST EXTENT PERMITTED BY LAW, getMRI AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AFFILIATES, AND LICENSORS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS, LOST DATA, OR LOSS OF GOODWILL, ARISING OUT OF OR RELATING TO THE SERVICES, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
IN NO EVENT WILL getMRI’S AGGREGATE LIABILITY ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICES EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO getMRI FOR THE SERVICES GIVING RISE TO THE CLAIM IN THE TWELVE (12) MONTHS BEFORE THE EVENT GIVING RISE TO LIABILITY, OR (B) ONE HUNDRED U.S. DOLLARS ($100). Some jurisdictions do not allow the exclusion or limitation of certain damages; in those jurisdictions, these limitations apply to the maximum extent permitted by law. Nothing in these Terms limits liability for fraud, willful misconduct, or any liability that cannot be limited by law.
14. Indemnification
You agree to defend, indemnify, and hold harmless getMRI and its affiliates, officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or related to (a) your use of the Services, (b) your violation of these Terms, (c) your violation of any law or any third-party right, or (d) any information or content you provide. We reserve the right to assume the exclusive defense and control of any matter subject to indemnification.
15. Governing law and venue
These Terms are governed by the laws of the State of Florida, without regard to its conflict-of-laws rules. Subject to Section 16, you and getMRI agree that any judicial proceeding (other than small-claims actions) will be brought in the state or federal courts located in Pinellas County, Florida, and you consent to personal jurisdiction and venue there.
16. Dispute resolution; binding arbitration; class waiver
Please read this section carefully — it affects your legal rights.
You and getMRI agree to first try to resolve any dispute informally by contacting legal@getmri.com. If we cannot resolve a dispute within 60 days, either party may elect to resolve the dispute by binding arbitration administered by the American Arbitration Association (“AAA”) under its Consumer Arbitration Rules. The arbitration will take place in Pinellas County, Florida, or by remote means. The arbitrator may award any relief a court could award, but only on an individual basis.
Class-action waiver. You and getMRI agree that disputes will be resolved only on an individual basis and not as a plaintiff or class member in any purported class, consolidated, or representative proceeding. The arbitrator may not consolidate claims or preside over any class proceeding.
Exceptions. Either party may bring an individual action in small claims court, and either party may seek injunctive or other equitable relief in court to protect intellectual-property rights. This Section does not waive any right you have under law that cannot be waived by contract.
Opt-out. You may opt out of this arbitration agreement within 30 days after first agreeing to these Terms by sending written notice to legal@getmri.com with the subject “Arbitration Opt-Out,” including your name and the email used for your account.
17. Termination
You may stop using the Services at any time. We may suspend or terminate your access to the Services at any time, with or without notice, if you violate these Terms or if we discontinue the Services. Sections that by their nature should survive termination (including disclaimers, limitations of liability, indemnities, dispute resolution, and governing law) will survive.
18. Changes to these terms
We may update these Terms from time to time. If we make material changes, we will update the “Effective date” above and, when appropriate, provide additional notice. Your continued use of the Services after the effective date constitutes acceptance of the updated Terms.
19. Miscellaneous
- Entire agreement. These Terms, together with our Privacy Policy and HIPAA Notice, are the entire agreement between you and getMRI about the Services.
- Severability. If any provision is held invalid or unenforceable, the remaining provisions will remain in full force.
- No waiver. Our failure to enforce any provision is not a waiver of our right to enforce it later.
- Assignment. You may not assign these Terms without our prior written consent. We may assign them in connection with a merger, acquisition, financing, or sale of assets.
- Force majeure. We are not liable for delays or failures caused by events beyond our reasonable control.
